Sokoto: Appeal Court Dismisses Matawalle’s Claim Over 40 Seized Vehicles

The Court of Appeal in Sokoto has upheld the judgment of the Federal High Court dismissing an appeal filed by former Zamfara State governor, Bello Matawalle, over the ownership of more than 40 official vehicles seized from his residence after leaving office in May 2023.

Vehicles Recovered in Police Raid

In June 2023, police officers raided Matawalle’s residence and recovered over 40 vehicles allegedly taken away by the former governor and members of his cabinet before the handover.

Appeal Dismissed by Justice Talba

Delivering judgment on August 8, 2025, Justice A.M. Talba, on behalf of a unanimous panel, dismissed Matawalle’s appeal (Appeal No. CS//S/2024 – Bello Muhammed Matawalle vs Nigeria Police & Others).

Court Affirms Police Investigation Powers

The court agreed with the Federal High Court in Sokoto that the police have the legal authority to investigate alleged crimes, including the removal of state-owned property.

Lack of Proof of Ownership

The appellate court ruled that Matawalle failed to provide credible evidence proving his ownership of the vehicles, and therefore, his claim of violation of fundamental rights could not stand.

Background to the Dispute

In June 2023, the Zamfara State Government gave Matawalle and his deputy five working days to return all allegedly stolen vehicles. When they failed to comply, the government sought and obtained a court order for retrieval.

Previous Court Order Overturned

Although Matawalle initially secured an interim order from the Federal High Court in Gusau directing the return of the vehicles, the case was later moved to the Sokoto division, which dismissed his suit in December 2023.

Appeal Court’s Final Position

The Appeal Court concluded that the state government’s retrieval process was lawful, did not infringe on Matawalle’s rights, and could not shield him from possible prosecution.
