The Western Cape High Court has dismissed an application by the convicted kidnappers of Joslin Smith to appeal their life sentences.
The group, which includes Joslin’s mother Racquel “Kelly” Smith, Jacquen “Boeta” Appollis, and Steveno van Rhyn, were convicted of human trafficking and kidnapping.
Judge Erasmus Rules Against Convicts
Judge Nathan Erasmus found no reasonable prospect of success in their appeal.
He said there was no justification for reducing a life sentence in a case involving the trafficking of a child, especially when the offenders had shown no remorse.
Life Sentences Upheld
The court reaffirmed that life imprisonment was appropriate in cases of child trafficking.
Judge Erasmus emphasised that the severity of the crime and the lack of repentance made the sentences fitting.
State Witness Granted Indemnity
Another accused, Lourentia Lombaard, was granted indemnity after turning state witness.
Although she had prior knowledge of the kidnapping arrangements and initially went along with a fabricated story, the court ruled that her conduct did not amount to a criminal offence.
NPA Welcomes Court’s Decision
Western Cape National Prosecuting Authority (NPA) spokesperson Eric Ntabazalila expressed satisfaction with the judgment.
He stated that the NPA would be prepared to oppose the matter in the Supreme Court of Appeal if necessary.
Search for Joslin Continues
Despite the convictions, the search for Joslin Smith remains ongoing.
Police continue their efforts to uncover answers about her disappearance.
